Keesari Sattamma v. Murthi Narayana
THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER Civil Revision Pet it ion No.1 4 0 9 of 2 0 1 9 ORDER:
This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioner/ plaintiff, challenging the order, dated 10.04.2019, passed in I.A.No.90 of 2019 in O.S.No.30 of 2016, by the Junior Civil Judge at Medak, whereby, the Court below ordered impoundment of the unregistered sale deed, dated 01.05.1990, executed by the husband of the petitioner/ plaintiff.
2 .
Heard the learned counsel for the revision petitioner and perused the record.
3 .
The material placed on record reveals that the learned Junior Civil Judge directed to send the unregistered sale deed, dated 01.05.1990, to the District Registrar to impound the same. The revision petitioner/ plaintiff contends that the said unregistered sale deed is bogus, does not exist at all and it was brought into existence to knock away the suit schedule property. These disputed facts are required to be adjudicated by the Court below after due trial of the suit. Since a simple sale deed, which is insufficiently stamped, is sought to be tendered in evidence, it is required to be impounded. There is no illegality or infirmity in the order under challenge. The Civil Revision Petition is devoid of merit and is liable to be dismissed.
4 .
Accordingly, the Civil Revision Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Civil Revision Petition, shall stand closed.
