HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 25956 of 2014 ORDER:

Heard learned Counsel for the petitioner and learned Standing Counsel for the respondents.

The petitioner who was appointed as Conductor on contract basis in the year 2007 was transferred from Pargi Bus Depot to Vikarabad Bus Depot along with four others vide letter dated 30.11.2010. However, the petitioner did not report to duty at Vikarabad Bus Depot within the time. He reported the duty with delay of one month. The petitioner states that he was not allowed to join the duty by the Depot Manager, Vikarabad on account of one month delay in reporting to duty. He therefore approached the Depot Manager, Pargi, who also did not issue

any order. In view of the same, the petitioner got issued a legal notice on 17.06.2014 and when the same was not considered and disposed of, he filed the present Writ petition. Though the Writ Petition was filed challenging the action of respondents 3 and 4 in not allowing the petitioner to join duty, in view of the oral submission of learned Counsel for the petitioner that consideration of legal notice dated 17.06.2014 and disposing of the same would serve the purpose, this Court feels that the Writ Petition can be disposed of in terms thereof. Accordingly, respondents 3 and 4 are directed to consider the legal notice dated 17.06.2014 got issued by the petitioner through his Advocate and pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
