THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 32793 OF 2017 O R D E R:

The complaint of the petitioner is that the 4th respondent Station House Officer, Chilakaluripet Police Station, Guntur District has been interfering with his family life and liberty, without following due process of law, at the instance of the 5th respondent.

Heard learned counsel for the petitioner.

Learned Government Pleader for Home (Andhra Pradesh), on instructions, submits that there is no complaint received by the Station House Officer or any of the officials. The complaint, which is alleged to have been filed with the respondent police authorities is, in fact, lodged with the S.C. and S.T. Commission, Amaravathi. The petitioner's counsel got issued a legal notice to one Sri Alla Appa Rao, the 5th respondent herein, for which, a reply was also sent marking a copy thereof to the Superintendent of Police (Rural), Guntur, the Home Minister and the Chairman, S.C. & S.T. Commission, Amaravathi.

In the facts of the present case, evidently, since no complaint is lodged with the police, the petitioner is at liberty to file the same, setting out his grievance. On such filing, the 4th respondent is directed to consider and take action on the said complaint, if warrants, in accordance with law.

Subject to the above, the Writ Petition is disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
