THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35757 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed to call for the records relating to Crime No.308 of 2016 of Nalgonda Police Station I Town, Nalgonda District, and quash the same.

The 3rd respondent/complainant lodged a report alleging that the petitioners herein even after handing over the property on the basis of sale deed, failed to pay the balance sale consideration and register a regular sale deed.

The case of the petitioners is that the sale deed was executed in the year 2014 itself after paying the entire sale consideration and that the present complaint is lodged since there is a rise in the price in that particular area.

Considering the facts and circumstances of the case, this Court is not inclined to interfere with the investigation in Crime No.308 of 2016, but at the same time, the 2nd respondent is directed to complete the investigation without arresting the petitioners and file Final Report, if any, in accordance with law. The petitioners are also directed to appear before the 2nd respondent as and when required for the purpose of investigation. 5.
