THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.4020 OF 2017 ORDER:

This petition is filed by the petitioners/A1 to A3 under Section 482 Cr.P.C. to quash the proceedings in C.C.No.318 of 2016 on the file of the Judicial Magistrate of I Class, Medak, Medak District, registered for the offences punishable under Sections 498-A and 323 r/w 34 IPC and 3 and 4 of Dowry Prohibition Act, 1961 2.

Party-in-person is present. At the time of hearing, the only relief sought for by the party-in-person is to dispense with the presence of the petitioners 2 and 3/A2 and A3 before the trial Court on each and every date of adjournment.

In view of submission made by the party-in-person, this Court is not inclined to go into the merits of the main case. 4.

There is no dispute with regard to the identity of the petitioners 2 and 3. Even if the presence of the petitioners 2 and 3 is dispensed with, no prejudice would be caused to the 2nd respondent. Therefore, presence of the petitioners-A2 and A3 in C.C.No.318 of 2016 on the file of the Judicial Magistrate of I Class, Medak, Medak District, is dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required. 5.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending, in this Criminal Petition shall stand closed.
