This writ petition is filed under Article 226 of the Constitution of India, for the following relief:

"To issue an order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ declaring the action of the respondents.no.2 and 3 in not conducting the elections to the respondent no.4 society even though the term of elected body was completed on 31-5-2016, is nothing but nothing but arbitrary, illegal, null and void and also violative of the provisions of the A.P. Co-operative Societies Act and Rules framed there under, and also violative of Articles, 14, 19 and 21 of the constitution of India. Consequently direct the respondents no.2 and 3 to conduct the elections to the respondent no.4 society immediately enabling its members to get enjoy the fishing rights in the Tank situated in Peravali village of Vemuru Mandal of Guntur District."

When the mater is taken up, an order bearing Proceeding No.355/D/2016, dated 13.10.2016, passed by the Collector & District Election Authority, Guntur District, is placed on record. In the said order, it is stated that in view of the circumstances reported by the Tahsildar Vemur and by virtue of powers conferred to District Election Authority under Section 22X (1) (i) of A.P. CS Act, 1964, the elections proposed to Peravali FCS is postponed till further orders. It is also stated that election process now postponed will recommence from the stage at which it was stopped soon after restoration of law and order situation in the village.

In view of the above, writ petition is closed, with a liberty to the petitioner to submit a representation to the respondents for reddressal of his grievance.

As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date:08.02.2017 grk
