Pradeep Kumar v. The Senior Intelligence Officer
HIGH COURT FOR THE STATE OF TELANGANA : HYDERABAD MAIN CASE NO: Crl.P.No.3259 of 2019 PROCEEDING SHEET 16.09.2022 KS,J IA.No.2 of 2022 The petitioner was arrested and subsequently released on bail on 26.06.2019 in Crl.P.No.3259 of 2019. At the time of granting bail this Court had imposed a condition that he shall not travel without permission of the Court and also he was asked to surrender the passport and Visa and in the event of undertaking any travel, the Court permission would be required.
Learned Senior Counsel appearing for the petitioner would submit that earlier on four occasions, the petitioner was permitted by the Court to travel and accordingly he had gone abroad and has come back in obedience of the Court orders. Learned Senior Counsel also submits that in the event of any notice or summon being issued to this petitioner he will appear within a period of one week inspite of his presence in any country.
Learned Senior Counsel appearing for Directorate of Revenue Intelligence would submit that the family members of the petitioner are not cooperating with the investigation inspite of summons being sent.
There is no complaint against this petitioner pursuant to the orders dt.04.07.2022 passed by this Court that this petitioner has violated any of the conditions mentioned therein. Further, it is needless to say the Agency has remedy to proceed against the accused who are not cooperating with the agency. In view of the aforesaid facts and circumstances and in view of the undertaking given by the learned Senior Counsel for the petitioner, the petitioner is permitted to travel from 15.09.2022 to 15.10.2022 and in the meanwhile in the event of the respondentAgency calling for the petitioner with a weeks notice, he shall appear without any excuse though he is permitted to travel 30 days.
Since this Court has granted permission to the petitioner to travel, the respondent authorities shall return his passport and USA green card to enable him to travel.
In the event of the petitioner flouting any of the orders, the respondent agency would be entitled to seek cancellation of the said order.
