THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.4057 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in reducing the age of retirement to 58 years from 60 years in so far as employees and officers of the second respondent organisation is concerned as illegal, arbitrary and unconstitutional and issue a consequential direction to the respondents to pay the back wages till the petitioner is attained the age of 60 years (Superannuation).

The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition with liberty to avail the remedies available to him under law. Permission is granted.

Hence, the Writ Petition is dismissed as withdrawn granting liberty as prayed for. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
