This criminal petition is filed for quash of the proceedings in Cr.No.83 of 2011, against the petitioner, who is A2, on the file of the Station House Officer, Boinpally Police Station, Karimnagar District. The offence alleged is under Section 304-B of the Indian Penal Code. 2.

Heard the counsel for the petitioner and the learned Public Prosecutor, appearing for the first respondent. None appears for the second respondent in spite of notice.

A perusal of the complaint, which is filed by the brother of the deceased, shows that the allegations are made against A1 to A4 that they demanded Rs.5,00,000/ - and also forced the deceased to get the land registered in favour of A1 and to get additional dowry. He stated that on 24.09.2011, the deceased called him and informed that the accused are beating her indiscriminately and demanding divorce from her. She also informed that, four days ago, A1 to A3 confined her in the bed room by locking the door and went away to village. Hence, the allegations are not only grave but also very specific against the accused. Hence, this Court opines that this is not a fit case for quash of proceedings.

However, considering the request of the counsel for the petitioner, the police are directed to follow Section 41-A of the Criminal Procedure Code before effecting the arrest of the petitioner.

In the light of the above, the criminal petition is dismissed. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
