THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4928 OF 2016 ORDER:
This Criminal Petition is filed by A.2 & A.3 under Section 482 of Cr.P.C. seeking to quash the orders dated 24.3.2016 passed by the III Additional Special Judge for CBI Cases, Hyderabad in dismissing Crl.M.P.No.156 of 2016 in C.C.No.22 of 2015 filed by the petitioners herein to record the presence of the accused through video conference.
After arguing for some time, since this Court is not inclined to quash the impugned orders, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioners before the trial Court. The learned standing counsel appearing for the respondent opposed the request of the petitioners. Considering the facts and circumstances of the case, the presence of the petitioners before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance for the purpose of trial.
The petitioners are directed to be represented by a counsel on all hearing dates. The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
