THE HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN C.R.P.No.2095 of 2018 ORDER:

The revision petition arises out of an order passed by the trial Court condoning the delay in filing the application to set aside the ex parte decree.

2. Heard the learned counsel on both sides.

3. The suit was for recovery of money. It was decreed ex parte and now the matter has come to the stage of execution. The property of the respondent is now sought to be brought to sale and the petitioner-decree holder has also obtained permission to participate in the auction.

4. The delay in seeking to set aside the ex parte decree is 224 days. The trial Court was satisfied with the reasons stated in the affidavit. Therefore, in the revision I do not wish to interfere with the exercise of discretion. Hence the Civil Revision petition is dismissed. There shall be no order as to costs.

5. As sequel, miscellaneous petitions pending in this revision, if any, shall stand closed.
