Petitioners And The State of Telangana, Rep., by its Principal Secretary, Revenue Department, Secretariat Buildings, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12252 OF 2019 ORDER :
Heard learned counsel for the petitioners and learned Government Pleader for Forest.
2.
Petitioners claim to be in possession and enjoyment of lands to an extent of Ac.1-24 guntas, Ac.0-32 guntas and Ac.0-34 guntas respectively in Sy.No.452/1/156 of Dharmapuram Village, Bayyaram Mandal, Mahabubabad District. Petitioners allege that the Forest officials are trying to evict them without following the due process. In support of their claim that they are in possession, petitioners filed copy of Adangal for the year 1997-98 and for the year 2018. 3.
Learned Government Pleader, on instructions, submits that what is contended by petitioners is not true; that petitioners are not in possession of the subject lands and some third parties are in possession and undertaking brick manufacturing activity and they were already issued notices.
4.
Taking note of these submissions, the respondents are directed not to evict the petitioners, if they are in physical possession without following the due process. However, this order does not come in the way of respondents proceeding against the persons who are stated to be in occupation and against whom steps are being taken to evict.
- 3 - 5.
With the above directions, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 19th June, 2019 Note :
