THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.865 of 2013 JUDGMENT:

This appeal is filed under Section 100 CPC by the defendant assailing the judgment and decree dated 05.06.2012 in A.S.No.18 of 2011 on the file of Senior Civil Judge Court, at Chodavaram, wherein whereby the decree and judgment dated 19.04.2011 passed in O.S.No.94 of 2009 on the file of Principal Junior Civil Judge Court, at Chodavaram, dismissing the suit filed by the plaintiff for recovery of the suit amount, was reversed. 2.

At the time of hearing, learned counsel for the appellant submitted that the purpose of filing of the appeal became infructuous.
