HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12393 of 2019 ORDER:

The prayer of the petitioner society in this case reads as under:

"... to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the tender notification dated 11.06.2019 issued by the 4th respondent herein calling for tenders for supply of man power on outsourcing basis in the 3rd respondent market committee as being illegal arbitrary unreasonable and violative of Articles 14 and 16 of the Constitution of India and contrary to the conditions imposed by the 2nd respondent and consequently set aside the tender notification dated 11.06.2019 issued by the 4th respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Perusal of the record reflects that the petitioner society was awarded the contract for the financial year 2017-18 in terms of the proceedings dated 27.3.2017 of the District Collector and Chairman, District Level Outsourcing Committee, Warangal Rural. Ms. G.Neeraja Reddy, learned standing counsel for respondent Nos.3 and 4, would state that the petitioner society was given an extension thereafter till the end of June, 2019. This being the situation, the petitioner society cannot assert any right in perpetuity by contending that this contract first needs to be cancelled before a fresh notification is issued. The contention of the petitioner is therefore bereft of merit. The Writ Petition is accordingly dismissed. This order shall however not preclude the petitioner society from submitting its tender in response to the tender notification now issued. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
