HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12243 OF 2008 ORDER:

This writ petition is filed seeking Writ of Mandamus, declaring the action of the respondents 1 and 2 in allowing the 3rd respondent as Member of the Jayanthi Nethaji Primary Agricultural Cooperative Credit Society Limited, Jayanthi Village, is without power or authority or jurisdiction and being contrary to Section 32(B) of A.P. Cooperative Societies Act and contrary to the Rules and the proceedings in Rc.No.2781/2005/E, dated 25.11.2006 of the 1st respondent, and consequently direct the respondents 1 and 2 to implement the proceedings dated 25.11.206 of the 1st respondent authorising the petitioner to act as President of the 2nd respondent Society.

It is submitted by the learned counsel for the petitioner that the writ petition is filed in relation to the dispute for the Election year 2005 and the learned Government Pleader for Cooperation submits that in 2013 fresh election has been conducted for the Jayanthi Nethaji Primary Agricultural Co-operative Credit Society Limited, Jayanthi Village, Veerulapadu Mandal, Krishna District. Recording the said submission and considering the fact that the writ petition is of the year 2008 and fresh elections has already been conducted in the year 2013, nothing survives in this writ petition.

Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any shall also stand closed.
