HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27493 OF 2017 ORDER:

The petitioners are members of fifth respondent Fishermen Cooperative Marketing Society, Moosi Project. The Society was registered on 21.08.1975 and the area of operation is spread over ten villages under Moosi Project in an extent of 2528 Hectares. The term of the present committee came to an end on 21.04.2017 and an election schedule was released by the election authority on 24.07.2017 for conducting elections to the fifth respondent Society as well as another Society. The election was scheduled to be held by issuing Election Notification on 11.08.2017. When the Election Authority postponed the elections by order dated 08.08.2017, the present writ petition is filed.

The learned Government Pleader representing the learned Advocate General produced before this Court the file relating to the conduct of elections and disclosed that the Election Authority apprehended some law and order problem in conducting elections, but the said reason was not mentioned in the impugned order. However, the learned Government Pleader submits that there is a problem with regard to the identification of the voters at the time of casting their votes and measures have to be taken for proper identification.

In view of the same, this writ petition is disposed of directing the fourth respondent to issue Election Notification immediately after receipt of a copy of this order and the Election Officer shall be specifically directed to ensure the identity of the voters before casting their votes either by asking them to produce Aadhar Card or any other valid proof issued by the Government. It is needless to observe that the elections shall be conducted as per the Voters' List available on 24.07.2017.
