Kasim Sharief, v. The Appellate Committee,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.No.11652 OF 2012
O R D E R
This writ petition is filed aggrieved by the action of the 1st respondent in not disposing the appeal filed by the petitioner under Section 11(1) of the Andhra Pradesh Regulation and Penalization of Unauthorizedly Constructed Buildings and Building Constructed in Deviation of the Sanction Plan Rules, 2007 against the order dated 30.12.2010.
The petitioner also filed W.P.M.P.No.30715 of 2012 seeking permission to file better affidavit. The said MP was allowed. In the additional affidavit filed by the petitioner, it is stated that by virtue of regularisation orders passed in favour of the 3rd respondent, the approach road to the petitioner's property has become narrow, that even an Auto, Ambulance or a Fire Engine cannot pass through the said road and also the easementary rights of the petitioner are affected. Heard the learned counsel for the petitioner and Sri Chatla Madhu, learned Standing counsel for the 2nd respondent. Since it is stated that appeal filed by the petitioner is pending before the 1st respondent, the 1st respondent is directed to dispose of the appeal as expeditiously as possible.
With the above direction, the writ petition is disposed of. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
