THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.1045 OF 2013 JUDGMENT:

This Second Appeal is filed under Section 100 of C.P.C., by the defendants, assailing the judgment and decree dated 14.09.2012 passed in A.S.No.84 of 2009 on the file of the Court of the I Additional District Judge, West Godavari, Eluru, wherein and whereby the judgment and decree dated 02.04.2009 passed in O.S.No.869 of on the file of the Court of the I Additional Junior Civil Judge at Eluru, decreeing the suit filed by the plaintiff for recovery of the suit amount, was confirmed. At the time of hearing, learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the appeal.

Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
