THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.8915 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioners/accused seek to quash the proceedings in Cr.No.18 of 2013 on the file of Wardhannapet Police Station, Warangal District, whereunder they were charged for the offences under Section 3 (i) (x) of SCs and STs Act.

When the matter came up for hearing, learned Public Prosecutor by producing a copy of the charge sheet submitted that the police have filed charge sheet on 23.09.2013, which was taken cognizance and registered as SC.No.10 of 2014 by the learned VII Additional District Judge-cum-SCs & STs Court, Warangal, and hence, the instant petition, which is filed for quashment of the proceedings in Cr.No.18 of 2013, has became infructuous and prayed to dismiss the petition.

Upon which, the learned counsel for petitioners has made an endorsement on the front side of the petition seeking permission of this Court to withdraw the Criminal Petition with a liberty to challenge the charge sheet by initiating appropriate proceedings. In view of the submissions of both sides, this Criminal Petition, which is filed for quashment of the proceedings in Cr.No.18 of 2013, is dismissed as infructuous and liberty is given to the petitioners/accused to challenge the charge sheet by initiating appropriate proceedings.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
