V.Nireekshana Babu v. The Government Ofap., Rep.By Its Principal Secretary
THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT APPEAL No.1513 of 2008 JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar) This writ appeal arises out of the interlocutory order dated 20.11.2007 passed by a learned Judge in W.P.M.P.No.10064 of 2007 in W.P.No.7831 of 2007. By the said interlocutory order, the learned Judge directed status quo obtaining as on that day with regard to the status of the third respondent in the writ petition, the appellant herein, to be maintained.
At the time of admission of this writ appeal, a Division Bench of this Court directed that the inter se seniority between the original writ petitioner and the third respondent should not be changed except with the permission of this Court. This order has been in operation since the year 2008.
As the writ petition relates to the year 2007 and would be ripe for final hearing, we are of the opinion that no further adjudication is called for in this writ appeal as the issues arising in the writ petition would have to be adjudicated before the learned Single Judge on their own merits.
The writ appeal is accordingly disposed of directing the parties to abide by the interim order dated 18.11.2008 passed in this writ appeal pending the final adjudication of the writ petition. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J _____________________ Dr. B.
