HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.16042 of 2016 ORDER:
Learned counsel for the petitioners would submit that the issue involved in the instant writ petition is squarely covered by the decision of this Court in Writ Petition No.5144 of 2016 and batch dated 19.02.2016. A copy of the said common order is filed in the material papers.
Learned Assistant Government Pleader appearing for the respondents would concede the submission made by the learned counsel for the petitioners.
What can be gathered from the common order dated 19.02.2016 passed in W.P.No.5144 of 2016 and batch is, that the same was passed following the decision of this Court in W.P.No.39888 of 2015 dated 09.12.2015 and that a large number of similar and identical cases have been disposed of by directing the authorities to release the seized vehicles in terms of G.O.Ms.No.3, Industries and Commerce (Mines.I) Department, dated 08.01.2015, as amended by G.O.Ms.No.15, Industries & Commerce (Mines.I) Department, dated 19.02.2015. In that view of the matter, the instant writ petition is disposed of following the order dated 09.12.2015, passed in Writ Petition No.39888 of 2015 and the common order dated 19.02.2016, passed in Writ Petition No.5144 of 2016 and batch directing the 2n d and 3rd respondents to consider release of the seized vehicles. As the petitioners complain that the applications
attempted to be filed by them were not received, they are directed to make fresh applications and upon filing such applications, the 2n d and 3rd respondents shall consider the same and pass appropriate orders as per G.O.Ms.No.3 dated 08.01.2015, as amended by G.O.Ms.No.15 dated 19.02.2015, for release of the seized vehicles within a period of one week from the date of receipt of a copy of this order. No order as to costs.
