THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.2 of 2018 in Crl.P.No.3903 of 2018 and Crl.P.No.3903 of 2018 COMMON ORDER:

The de-facto complainant and her counsel Sri G.Narasimha Rao are present. Accused 2, 4 & 6 and their counsel Sri Ch.Venkat Raman are present. One Lyagala Jayamma, who is the younger sister of the de-facto complainant, is also a beneficiary of the site in dispute. Learned Additional Public Prosecutor brought to the notice of this Court that in the compromise her presence is also required. Since she is suffering from ill-health she executed a General Power of Attorney dated 11.04.2018 in favour of the defacto complainant and the same is produced. 2) The de-facto complainant lodged FIR No.587 of 2017 with Hayathnagar PS, Rachakonda District against the accused for the offences under Sections 419, 420, 468, 406, 471 and 506 r/w 34 IPC and 156(3) Cr.P.C. and the investigation is stated to be pending.

It is submitted that at the intervention of elders, parties have settled the matter in respect of offences under Sections 419, 420, 468, 406, 471 and 506 r/w 34 IPC and 156(3) Cr.P.C. and entered into a compromise and hence, the compromise may be recorded and proceedings in FIR No.587 of 2017 may be quashed in the interest of justice.

3) Having regard to the above said submission and considering the fact that it is a property dispute between the de-facto complainant and the accused and the compounding of offence will have no adverse affect on the

society and further, driving the parties to trial will not serve any useful purpose and also following the decision reported in Gian Singh v. State of Punjab and another1 this interlocutory application is allowed and compromise is recorded and consequently the proceedings in FIR No.587 of 2017 on the file of Hayathnagar PS, Rachakonda District are quashed against the petitioners/A2, A4 & A6.

In the result, both I.A.No.2 of 2018 and Crl.P.No.3903 of 2018 are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
