M.K. Ghouse Mohiuddin v. Zohra Shameem
HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.2882 OF 2015 ORDER:
No representation for the petitioner.
2. Learned counsel for the respondents submitted a copy of judgment, dated 19-08-2015, in O.S. No.6393 of 2005, passed by the learned VI Junior Civil Judge, City Civil Court, Hyderabad. On perusal of the said judgment, the trial Court while dismissing the suit, allowed the counter claim by passing a decree in the said suit. The order under challenge arises out of I.A. No.790 of 2014 filed under Section 151 CPC in the said suit for reopening the case in the said suit which was dismissed. Since the suit itself was dismissed by the trial Court, nothing survives in the instant revision.
3. Therefore, the Civil Revision Petition is dismissed. No order as to costs.
4. As a sequel thereto, miscellaneous petitions, if any, pending in the revision, stand disposed of.
