HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.3 of 2018 in Crl.P.No.3770 of 2018 and Crl.P.No.3770 of 2018 COMMON ORDER:

Criminal Petition No.3770 of 2018 is filed by sole accused seeking to quash the proceedings against him in Cr.No.15 of 2015 of RPS, Nizamabad registered for the offences under Sections 354D and 509 IPC.

2) The brief allegations of the complaint are that on 23.02.2018 when fiancee of the complainant and her friends were proceedings to Basara and they reached Platform No.1 of Nizamabad Railway Station at that time the accused, who is the Railway Constable, misbehaved with the fiancee of the complainant and he gave his mobile number on a slip and insisted her to talk with him. Basing on the said complaint the police registered a case in Cr.No.15 of 2015. 3) Investigation is reported to be pending.

4) While so, petitioner/Accused and defacto complainant filed I.A.No.2 of 2018 seeking permission of this Court to compound the offence. By a separate order dated 27.04.2018, this Court granted permission for compounding the offence.

5) Today, parties are present and they are identified by their respective counsel.

6) On enquiry by this Court, the defacto complainant affirmed the contents of the joint memo and submitted that he has no objection for quashing the proceedings against the petitioner/accused. 7) Considering the same and following the decision reported in Gian Singh v. State of Punjab and another1, I.A.No.3 of 2018 is allowed and permission is accorded to the parties to compromise the matter and consequently, Crl.P.No.3770 of 2018 is allowed and the proceedings in Crime No.15 of 2018 are quashed sofaras petitioner/accused is concerned and he is acquitted of the offences for which he has been charged.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
