Diddi Venkata Rama Narsimha v. The State Of Telangana
THE HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.22880 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue Writ of Mandamus declaring the action of the respondents 4 to 6 in harassing the petitioners and their family members by calling to the police station and misbehaviour, at the instigation of the 7th respondent, as illegal and arbitrary."
When the matter is taken up, written instructions dated 30.07.2015 furnished by the Station House Officer, Venkatapuram Police Station, Khammam District have been placed on record by the learned Government Pleader for Home. In the said written instructions, it is stated as follows :- "It is respectfully submitted that, on 12.07.2015 this respondent received a Telugu written complaint from Smt.Bathula Rajani against her husband Diddi Venkata Praveen Kumar i.e., petitioner No.2 herein and her in-laws stated that, she got married with petitioner No.2 herein on 14.05.2014, at the time of marriage her parents given Rs.8.00 lakhs cash, 23 tulas of gold and one acre land as dowry. After the marriage her husband and in-laws and particularly her husband's brother-in-law and sister started harassing her physically and mentally for getting additional dowry otherwise they will perform another marriage to her husband, therefore, requested to take necessary action.
On the same day after receipt of the complaint this respondent made a GD entry and called the both parties and conducted counseling and they left at that time itself. In the meantime this respondent received the present writ petition, in which the petitioner contended that this respondent police harassing the petitioners and their family members by calling to the police station, detained them till night i.e, upto 9.00 PM and misbehaved with them, at the instigation of the 7th respondent, is denied. In this regard, except for the purpose of counseling this respondent never called either the petitioners herein or the 7th respondent, as such, the allegations raised by the petitioners against this respondent are totally false and baseless." On noticing the above instructions, learned counsel for the petitioner requested to record the said instructions.
In view of the same, while recording the above mentioned instructions, this Writ Petition is closed. However, it is made clear that the respondent police authorities
shall follow the due process of law. No costs. As a sequel, the miscellaneous applications, if any, shall stand closed. ___________________ A.V. SESHA SAI, J Date : 03.08.2015 ssp
