HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 6263 of 2016 ORDER:

The appeal filed by the petitioner under Section 10 of the A.P. Land Encroachment Act, 1905 was heard and dismissed by the 3rd respondent on 06.02.2016 which is questioned in this writ petition.

The petitioner has a further remedy of filing a revision petition before the District Collector, 2nd respondent herein, and also seeking either regularization or allotment of other alternative land. But, all that can be done, only if the petitioner approaches the 2nd respondent against the impugned order. The petitioner claims to be running a party office since 1982 on the land in question, and apprehending dispossession, filed the present writ petition without approaching the 2nd respondent by way of a revision petition.

In my view, interference by this Court at this stage is not called for, as the petitioner is required to exhaust the alternative remedy available to them and there is no reason why the petitioner cannot move the 2nd respondent for appropriate relief by filing a revision

petition. If and when the petitioner files such a revision petition, this Court has no doubt that the 2nd respondent shall examine the same on priority and issue necessary directions.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
