HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6486 of 2003 ORDER:

This writ petition is filed challenging the award dated 16.2.2001 passed by the Labour Court in I.D.No.31 of 2000, wherein no relief was granted.

The learned Counsel for the petitioner submits that the husband of the petitioner was employed in the respondentCorporation as a driver and he was removed from service and challenging the same, the legal representatives of the deceased employee filed the above I.D., and the Labour Court vide award dated 16.2.2001 dismissed the same. He further contended that the petitioner is seeking service benefits of the deceased employee for the services rendered by him prior to his removal.

Having considered the above submissions, this Court is of the view that this writ petition can be disposed of directing the respondent-Corporation to pay the service benefits of the deceased employee for the services rendered him prior to his removal, to his legal representatives.

Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to pay the service benefits of the deceased employee for the services rendered by him prior to

his removal, to the legal representatives of the deceased employee, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
