THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY TRANSFER CRIMINAL PETITION No.86 OF 2018 ORDER:

This transfer criminal petition, under Section 407 of the Code of Criminal Procedure, 1973 (for short 'CrPC'), is filed by the petitioner, who is respondent in F.C.M.C. No.47 of 2017 pending before the Judge, Family Court, Kadapa, to withdraw and transfer of the F.C.M.C. to the Court of Principal District Judge, Ranga Reddy District, on various grounds.

During hearing, learned counsel for the petitioner after arguing the matter for a while, requested this Court to dispense with the personal appearance of the petitioner in F.C.M.C. No.47 of 2017.

This court cannot exercise power under Section 205 Cr.P.C. However, the petitioner is at liberty to approach the Judge, Family Court, Kadapa, either by filing an application under Section 205 Cr.P.C. or under Rule 37 of Criminal Rules of Practice authorising the counsel or any other person to represent him in F.C.M.C. No.47 of 2017.

On filing such application, the Judge, Family Court, Kadapa District, is directed to dispose of the same in accordance with law within a period of one week from the date of filing of such application.

Accordingly, the transfer criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
