HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.10235 OF 2018 ORDER:

The case of the petitioner is that he joined the services of respondent-organization as Junior Estates Officer in E1 grade in the year 1998 and eventually got promotions upto E-4 grade till April, 2013.

The grievance of the petitioner is that he is eligible for being considered for next promotion i.e. E-5 grade with effect from April, 2016, but the same has not been considered, hence this writ petition.

Learned Standing Counsel for the respondents stated that pending writ petition, the case of the petitioner has been considered and he is promoted to E-5 grade. However, petitioner's counsel states that such promotion is not reckoned from the date of petitioner's eligibility i.e. from April, 2016. In other words, he contends that though promotion is given to the petitioner, it has not been effected retrospectively i.e. from April, 2016.

In such view of the matter, it is for the authorities to take a decision on that aspect. In the circumstances, it is open for the petitioner to make a representation to the 2nd respondent in that behalf and on such a representation being made, the 2nd respondent to consider the same and take a decision

thereon keeping in view the policy and guidelines governing the field and in accordance with law. The writ petition is disposed of accordingly. Miscellaneous petitions, if any pending in this case shall also stand disposed of. There shall be no order as to costs.
