HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.339 OF 2016 ORDER:

This is an application filed to withdraw F.C.O.P.No.110 of 2015 from Family Court, Nellore and transfer to competent court at Tenali, Guntur District, for disposal in accordance with law.

Wife filed this application. According to her affidavit, she is resident of Nandivelugu village, Tenali Mandal, Guntur District and her marriage was solemnized on 17-8-2013 at NKNR Garden, Kukatpally, Hyderabad as per Hindu Rites and Custom and thereafter, they are blessed with male child and subsequently due to differences the respondent filed Family O.P. before Family Court, Nellore and she filed M.C. and D.V.C. before II Additional Judicial First Class Magistrate, Tenali, Guntur District. She stated that distance between her place of residence and Nellore is 250 K.M. and she has life threat in the hands of respondent and his family members at Nellore. For these reasons, she prayed for transfer of O.P. from Nellore to Tenali.

This court permitted the petitioner to take personal notice to respondent through registered post with acknowledgement due and in compliance of said order, advocate for petitioner filed memo dated 9-8-2016 stating that notice sent to respondent is duly served on respondent and along with memo postal acknowledgement is filed according to which respondent received notice on 14-7-2016. In spite of service of notice, respondent neither appeared in person nor through any advocate.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit and also considering the convenience of wife, F.C.O.P. No.110 of 2015 is withdrawn from Family Court, Nellore and transferred to Senior Civil Judge, Tenali for disposal in accordance with law. Accordingly, this petition is ordered. No costs. As a sequel to the disposal of this petition, Miscellaneous Petitions, if any, pending, shall stand dismissed.
