O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) The petitioner seeks a writ of habeas corpus to produce his brother, Battula Prakash, allegedly being detained illegally by the police and to set him at liberty.
The Circle Inspector of Police, Thorrur, filed a counter-affidavit detailing the factum of the arrest of the petitioner's brother and his remand to judicial custody.
No reply was filed rebutting the aforestated counter-affidavit averments.
There was no representation for the petitioner or his learned counsel when this matter was taken up on 21.09.2017 and again on 10.10.2017. It was accordingly directed to be posted 'for dismissal' on 11.10.2017.
Today, though the matter appears under the caption 'for dismissal', there is no representation, yet again, for the petitioner or his learned counsel.
The writ petition is accordingly dismissed for non-prosecution. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
