THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5356 of 2011

ORDER

This writ petition is filed praying to grant the following relief; "to issue an order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not extending the Staff Retirement Benefit Scheme monthly benefit to the petitioner since 31.10.2009, as high handed and arbitrary action, contrary to circular instructions and as such liable to be set aside in the interest of justice by ordering to pay the arrears along with interest from 31.10.2009 forthwith."

2. This Court, by elaborate order dated 07.04.2011 made in W.P.M.P.No.6656 of 2011, directed the respondents to release the monthly benefit amount payable to the petitioner commencing from 1st November, 2009 within thirty days from the date of receipt of a copy of the said order under the Staff Retirement Benefit Scheme.

3. When the matter is called, learned Standing Counsel for the respondents Corporation, on instructions, states that as directed by this Court, the amount under the said Scheme is being released every month to the petitioner.

4. In view of the said submission, the grievance of the petitioner stands attended and no cause survives for consideration in the writ petition.

5. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
