THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41806 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in issuing notice in F.I.R.No.363 of 2016 as illegal and arbitrary, and consequently to set aside the same, and also the action of the respondents in interfering with the life and liberty of the petitioner as illegal and arbitrary, and consequently to direct the respondents not to call the petitioner to the police station.
Heard and perused the material.
The above crime was registered for the offences under Sections 420, 468 and 471 IPC. It is alleged that the de facto complainant purchased a four wheeler from M/s.Malik Cars Private Limited, Malakpet, Hyderabad, and the said vehicle was delivered and when the complainant questioned regarding registration, it was informed that the transport vehicles would be registered at Sangareddy. Believing the same, the complainant paid the amounts and later, he came to know that the registration of the vehicle purchased by him was banned. Learned counsel for the petitioner challenges the notice issued under Section 91 CrPC., to the petitioner to personally appear before the investigating agency and to produce the documents for further investigation. This Court is not inclined to interfere with the investigation in the above crime.
The petitioner is directed to appear before the investigation agency and submit relevant documents for the purpose of investigation. The respondents are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The petitioner is directed to appear before the investigation agency as and when required.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.12.2016 pln
