THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 21027 of 2004 ORDER:

The petitioners, 25 in number, filed this case alleging that the respondents were trying to dispossess them from their respective huts despite the valid pattas granted to them by the Mandal Revenue Officer, Medikonduru Mandal, Guntur District, under proceedings dated 02.10.2004.

Taking note of this aspect, this Court, by order dated 17.04.2004, directed that as long as the pattas granted in favour of the petitioners were in force, they should not be dispossessed from their respective huts.

Though 10 years have lapsed since the institution of the Writ Petition, the respondents have not chosen to file a counter-affidavit. In that view of the matter, accepting the averments made by the petitioners in their affidavit, the Writ Petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioners over the lands covered by the pattas granted under proceedings dated 02.10.2004 of the Mandal Revenue Officer, Medikonduru Mandal, Guntur District, except in accordance with the due procedure laid down by law.

Pending Miscellaneous Petitions, if any, shall stand closed. No costs.
