THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8319 of 2016 ORDER:

Heard Sri Papaiah Peddakula, learned counsel representing Sri Sricharan Telaprolu, learned counsel for the petitioners, and the learned Assistant Government Pleader for Education appearing for the State.

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of "Writ of Mandamus" declaring the inaction of the Respondent No.

3 herein in ratifying the admissions of 21 out of state students, listed in Annexure-I, whose details were submitted to the 4th Respondent on 18-02-2016 along with the representation dated 17-02-2016, which details are thereafter forwarded by the 4th Respondent to the 3rd Respondent for consideration, who were admitted by 2nd petitioner institution into polytechnic course for the academic year 2015-16 being assailed as illegal, arbitrary and violative of Article 14 of the Constitution of India apart from being violative of principles of natural justice and consequently direct the respondents 2 to 4 to forthwith ratify and approve the said admission of out of state students listed in Annexure-I and admitted in the 2nd petitioner institution under the left over vacant seats (Spot Admissions) category and treat the said admissions as valid for all purposes and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case."

It appears that the representation dated 17.02.2016 made by the 2nd petitioner - College is pending consideration before the State. Thereunder, the 2nd petitioner - College sought ratification of the admissions of out of State students made by it for the academic year 2015-2016. Learned counsel would state that the exams for this batch of students are scheduled to commence from 21st March, 2016. That being so, the interests of the students cannot be put at risk owing to the administrative delays, be it on the part of the 2nd petitioner - College or the State.

The writ petition is accordingly disposed of directing the authority concerned to consider the representation dated 17.02.2016

made by the 2nd petitioner - College and take appropriate action thereon in accordance with law. In the event the request made thereunder for ratification of the admissions of out of State students is rejected, the reasons therefor shall be recorded and duly communicated to the 2nd petitioner - College. This exercise shall be completed expeditiously and in any event, not later than three (3) days from the date of receipt of a copy of this order.
