Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a fair price shop dealer of shop No.23, Puppalaguda Village, Rajendranagar Mandal, Ranga Reddy District. While so, the Assistant Supply Officer (Civil Supplies), inspected the shop on 13.06.2015 and noticed some variations in the quantities. Proceedings under Section 6-A of the Essential Commodities Act were initiated against the petitioner and the same are pending. When the stocks were not supplied even though the authorization of the petitioner is in subsistence till today, the present Writ Petition is filed.

The learned Government Pleader received instructions which confirm the fact of inspection of the shop by the Assistant Supply Officer, on 13.06.2015 and initiation of 6-A proceedings against the petitioner. At the time of receiving instructions on 25.06.2015, it is stated that the file is under circulation for issuance of show cause notice. Since it is clear that no show cause notice was issued by the competent authority in respect of the alleged irregularities and the authorization of the petitioner is in force as on today, the petitioner is entitled to receive the stock. 4.
In the circumstances, this Writ Petition is disposed of directing the third respondent to release the stock to the petitioner so long as her authorization is in force. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
