THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 393 of 2015 ORDER:
The grievance of the petitioner in this writ petition is that an enquiry is being conducted against respondents 3 to 5 who are his tenants in the premises owned by him; and that he being the owner of the premises, without issuing notice to him, conducting an enquiry against respondents 3 to 5 as encroachers would cause irreparable loss to him.
2. On the other hand, learned counsel for respondents 1 and 2 seeks time to get instructions.
3. As can be seen from the pleadings in the writ affidavit, the petitioner states that he was not given any notice with regard to the enquiry that is being conducted against respondents 3 to 5 who are said to be his tenants. It is obvious that any proceedings taken against the petitioner, without putting him on notice, would not be binding on him.
4. In that view of the matter, this writ petition is closed, giving liberty to the petitioner to challenge the proceedings specifically, if any, initiated against him; as, at this stage, filing of a writ petition, in anticipation, would be premature. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
