Heard the learned counsel for the petitioner and the learned Public Prosecutor.
2. The present Criminal Petition came to be filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, by the petitioner/A.1 seeking enlargement on bail in connection with Crime No.71 of 2016 of Mamada Police Station, Adilabad District, registered for the offence punishable under Section 304-B read with 34 IPC.
3. It is to be noted that earlier, the petitioner along with another accused approached this Court by filing Criminal Petition No.10603 of 2016, which was dismissed by this Court on 27.07.2016 on merits.
4. Learned counsel for the petitioner submits that children of the petitioner, who are aged about four years and six years, are with the mother of the petitioner; that the petitioner is an agriculturist and as the agricultural season has commenced, seeks bail.
5. Learned counsel Public Prosecutor opposed the petition.
6. It is to be noted that the earlier application of the petitioner was rejected on 27.07.2016 and in the absence of any change either on facts or on law, I am not inclined to consider the request of the petitioner at this stage. However, the petitioner is at liberty to move an application before the trial Court showing change in
circumstances, in which event the same shall be dealt with, in accordance with law, on the same day.
