THE HON'BLE SRI JUSTI CE U.DURGA PRASAD RAO CRL.P.NO.3 7 6 7 OF 2 0 1 8 ORDER:- Heard both sides.

This petition is filed by the petitioner/ A-1 under Section.482 of the Code of Criminal Procedure, 1973 to quash the proceedings against him in Cr.No.26 of 2018 of Pedemul Police Station, Vikarabad District, registered for the offence under Sections.324 read with 34 IPC and 3(1)(r)(s), 3(2)(va) of SC & ST (POA) Act, 2015.

It is brought to the notice of this court that A-2 is concerned, this court by order dated.22-03-2018 in Crl.P.No.3518 of 2018 directed that investigation shall lead to logical conclusion and Investigation Officer shall strictly follow the procedure contemplated under Section 41-A Cr.P.C. towards petitioner/ A-2 during the course of investigation and the said petitioner shall cooperate with the Investigation Officer for smooth completion of investigation. Since the petitioner/ A-1 also stands on the same footing, this court directs in the present application that Investigating Officer shall follow the guidelines rendered in Ar n esh Ku m ar vs. St at e of Bih ar 1 and the procedure contemplated under Section 41-A Cr.P.C. during the course of investigation. The petitioner/ A-1 in his turn shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, pending if any, shall stand closed.
