HONOURABLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.1779 OF 2007 ORDER:

This Writ Petition is filed by the petitioner seeking to declare the action of the 1st respondent in issuing the impugned proceedings Rc.G2/2766/2006 dated 7-1-2007 and the consequential notification under Section 6 of the Land Acquisition Act,1894 in Rc.No.G2/2766/2006 dated 18-1-2007 as illegal and arbitrary and consequently direct the respondents to consider the objections filed by the petitioner and drop the proposal of acquisition of the land belonging to the petitioner admeasuring Ac.2.78 cents and Ac.0-77 cents in Sy.No.1/2B1C2 and 1/2B1B of Mukthinutalapadu village, Ongole Mandal, Prakasam District.

This Writ Petition was admitted on 1st February, 2007 and interim stay was granted on the same day.

Today, when the matter has come up for hearing, learned Government Pleader passed on writ instructions issued by Revenue Divisional Officer on 13th June, 2013 stating that the land of an extent of Acs.2.78 cents in Sy.No.1/2b1C and Acs.0-77 cents in 1/2B1B of Mukthinutalapadu village, Ongole Mandal, Prakasam District pertaining to Land owner Sri Katragadda Venkata Narsu son of Narasimhulu for which draft notification and draft declaration published for acquiring this land for provision of house sites to weaker section beneficiaries is not required at present and further action, in the matter as per L.A. Act, will be initiated. Basing on the said written instructions, this Writ Petition is allowed setting aside the impugned proceedings Rc.G2/2766/2006 dated 7-1-2007 and notification under Section 6 of the Land

Acquisition Act,1894 in Rc.No.G2/2766/2006 dated 18-1-2007. No costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
