The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case). ORDER:
The main grievance of the petitioners is that the respondent No.2-Appellate Authority is not passing any orders in the appeal filed by them against the order of refusal passed by the respondent No.3-Joint Sub-Registrar-ll, dated 03.06.2020. Learned counsel for the petitioners has stated that even though the appeal was heard and reserved on 20.06.2020, till date no orders are passed by the respondent No.2.
Learned Government, on instructions, has stated that due to the present pandemic situation prevailing in the Country, the appellate authority could not pass any orders in the appeal and requests this Court for granting some time. ln view of the above made submissions, to meet the ends of justice, the respondent No.2 is directed to pass necessary orders in Appeal No.5657/G1i2020 filed by the petitioners, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. However, if there is any change of the incumbent in the office of the appellate authority, the appellate authority shall put the petitioners again on notice and after affording an opportunity of hearing, shall pass necessary orders on merits, strictly in accordance with law, as expeditiously as possible, preferably within a period of
six weeks from the date of receipt of a copy of this order. A copy of the order shall be communicated to the petitioners.
