THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17852 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.31 of Pathagunta Village, Vedurukuppam Mandal, Chittoor District, in the year 2008. While so, the authorization of the petitioner was suspended pending enquiry by proceedings of the 3rd respondent dated 30.03.2015, on the basis of the report submitted by the 4th respondent. The petitioner preferred an appeal to the Joint Collector, Chittoor, who suspended the order of suspension and directed the 3rd respondent to complete the enquiry. Now the 3rd respondent completed the enquiry after issuing a show cause notice on 03.05.2015 and passed a final order cancelling the authorization of the petitioner by order dated 06.06.2015. Challenging the same, the present writ petition is filed.

3. This Court perused the impugned order dated 06.06.2015 and is not inclined to interfere with the said order. Since there is a provision for appeal, the petitioner is given liberty to file an appeal against the impugned order within a period of 15 days from the date of receipt of a copy of the order and the appellate authority is directed to complete the enquiry within a period of three months from the date of receipt of the appeal from the petitioner. Till completion of the enquiry in appeal and passing of final order, the impugned order dated 06.06.2015 passed by the 3rd respondent shall be under suspension, as the petitioner continued to work as a dealer till passing of the impugned order.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
