Aggrieved by the action of 2nd respondent - Regional Passport Officer, Secunderabad, Telangana State, in closing the passport application of the petitioner vide application No.HY1060819006917 dated 29.12.2017, the present writ petition is filed. Heard the learned counsel for the petitioner. Sri K.Lakshman, learned Assistant Solicitor General, appearing for respondents, on instructions, submitted that in police verification, it was found that a criminal case in CC.No.20212106470213 was found to be pending on the file of XX Metropolitan Magistrate, Secunderabad, and as this information was suppressed by the petitioner, he was issued with show cause notice dated 18.01.2018, and as the petitioner did not respond, his application was closed. He states that as per Gazettee Notification GSR 570E, dated 25.08.

1993, the request of the petitioner for issuance of the passport to travel abroad can be considered only if he gets permission from the court where the criminal case is pending. The fact that the above stated criminal case is pending against the petitioner, is not disputed. Hence, in view Gazettee Notification GSR 570E, dated 25.08.1993, liberty is given to the petitioner to make necessary application before the criminal court, where the above referred criminal case is pending, and it is for the said court to consider the same and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within two weeks from date of making application, and based on such orders, petitioner may file fresh application seeking passport, which shall be considered in accordance with law.
