Gottimukkula Prameela, v. The Government Of Andhra Pradesh,
HON'BLE SRI JUSTICE S.V.BHATT W.P. No.6974 OF 2014 ORDER:
The petitioner challenges notice dated 24.02.2014 issued by respondent No.4 calling upon the petitioner and a few others to attend survey/ resurvey the 4th respondent proposes to conduct in Survey Nos.964, 965, 967 and 973 of Parlapalli Village, Thimmapur Mandal, Karimnagar District as illegal and arbitrary. The survey was scheduled to be held at 10.30 a.m. on 04.03.2014. The writ petition was posted for admission on 11.03.2014, 18.03.2014 and 01.04.2014. This Court has not granted an order restraining the 4th respondent from proceeding with the survey contemplated through notice dated 24.02.2014. In spite of it, from the written instructions dated 13.03.2014, it is not clear whether the survey, as a matter of fact, was undertaken and completed on 04.03.2014.
Respondents 2 to 5, if have reason to believe that survey numbers require survey or resurvey and to identify the property as per the Award said to have been passed by the Revenue Divisional Officer, are free to issue survey notice and proceed in accordance with law. As the date and time on which the survey about to be completed is over, no further order is required in the writ petition.
The writ petition is dismissed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date: 07.07.2017 Stp
