This appeal, under Section 173 of the Motor Vehicles Act, 1988, is filed by the appellant-National Insurance Company Limited, challenging the Award, dated 30.12.2003, passed in O.P.No.984 of 2000 by the Chairman, Motor Accident Claims Tribunal-cum-Chief Judge, City Civil Court, Hyderabad.

During the course of hearing, it is brought to the notice of this Court that the respondent herein/ claimant filed M.A.C.M.A.No.3255 of 2004 before this Court and the said appeal was disposed of by this Court on 29.07.2010, enhancing the compensation. This appeal is filed by the Insurance Company challenging its liability. Since the question involved in this appeal was already determined by this Court in the aforementioned appeal, the cause in this appeal does not survive for adjudication.

Accordingly, this appeal is dismissed as infructuous. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
