ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.1 in Crime No.37 of 2026 of Mulkanoor Police Station, Warangal Police Commissionerate, registered for the offences punishable under Section 5 r/w 6 of The Explosive Substances Act, 1908.

The brief facts of the case are that, on 12.03.2026, while conducting patrolling near Gatlanarsingapur village, police intercepted an auto on suspicion. Upon checking, a large quantity of explosives, including gelatin sticks, detonators, and cordex wire, were found being transported without valid license. The petitioner confessed that he procured the explosives from his relative Vallapu Rajaiah to sell them illegally for blasting agricultural wells. The police secured panch witnesses, conducted seizure proceedings and seized the explosives and vehicles. Basing on the same, the police registered a case against the petitioner for the aforementioned offences.

Heard Sri Anuganti Praneeth, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and even according to the prosecution, the petitioner is carrying the said explosives at the instance of accused No.2 and

that the accused No.2 is a license holder to sell the said explosives and the same were used to dig the well. It is further submitted that there is no such offence committed by the petitioner and that the petitioner is in jail from 13.03.2026 and the material part of the investigation is already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that the petitioner herein is illegally transporting the alleged explosives without any proper license and there is no such license obtained by the petitioner herein and that the material part of the investigation is not yet completed. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 13.03.2026, who is arrayed as accused No.1 and as seen from the record, the allegations against the

petitioner is that he is carrying the explosives at the instance of accused No.2. Accused No.2 was already granted bail by this Court. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions. i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class at Hanumakonda.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
