Nallajarla Perraju v. State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10236 of 2018 ORDER:
In this writ petition, the only grievance of the writ petitioner is that pursuant to the registration of the case in Crime No.36 of 2018 on 12.12.2018, the 6th respondent - Station House Officer, Jaggampet Police Station, is not conducting free, fair and timely investigation and he is repeatedly asking the petitioner to furnish cell phone numbers and addresses of the accused and he is further directing the petitioner to produce documents and refusing to acknowledge the receipt of the documents, even though the petitioner is prepared to produce copies of the necessary documents.
2.
I have heard the submissions of the learned counsel for the petitioner and of the learned Government Pleader for Home (AP) appearing for the respondents. I have perused the material record. 3.
Learned counsel for the petitioner, while reiterating the contentions of the petitioner, would submit that the accused mentioned in the report of the petitioner fabricated the documents with regard to cultivable land of the petitioner of an extent of Ac.6.25 cents in Narendrapatnam Village, Jaggampet Mandal, and obtained bank loan on the basis of fabricated documents and, thus, cheated the petitioner. 4.
Learned Government Pleader for Home, on oral instructions, would submit that having registered the crime, the police officer concerned has taken up investigation and that the allegations made in the
petition by the petitioner are false and that, in any view of the matter, the Investigating Officer would complete the investigation by following the procedure established by law and file a final report depending upon the result of the investigation.
5.
Recording the submissions, the Writ Petition is disposed of directing the 6th respondent to complete the investigation into the aforestated crime by due adherence to the procedure established by law and file a final report before the Court of the learned Magistrate concerned, as expeditiously as possible. It is made clear that the petitioner shall extend necessary cooperation to the Investigating Officer during the course of investigation into the crime.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
