HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12413 of 2019 ORDER:
This writ petition is being disposed of at the stage of admission with the consent of both parties.
This writ petition is filed seeking a writ of Mandamus declaring the action of the respondents in not providing employment to the 2nd petitioner under compassionate scheme basing on the application dated 22.04.2019 as arbitrary, illegal and violative of G.O.Ms.No.504 dated 11.08.2008 and G.O.Ms.No.50 dated 21.02.2014 and also Articles 14 and 21 of the Constitution of India and sought a consequential direction to direct the respondents to provide employment to the 2nd petitioner as per the above said G.Os. Heard Sri B.H.R.Choudary, counsel for the petitioners, and the Government Pleader for GAD appearing for the respondents. It has been contended by the 1st petitioner that his eldest son was killed by the extremists on 06.08.1991 and the State Government has taken a policy decision vide G.O.Ms.No.504 dated 11.08.
2008, wherein the State Government had come up with a policy to provide employment to one of the family members of the victims who were killed by the extremists. The 1st petitioner has submitted an application on 22.04.2019 requesting the respondents to provide employment to the 2nd petitioner, who is the son of the 1st petitioner, in terms of the aforesaid G.Os.
AKS,J W.P.No.12413_2019 passed any orders on the said representation nor considered the case of the 2nd petitioner for appointment on compassionate grounds. Therefore, counsel for the petitioners submitted that appropriate orders be passed in the writ petition directing the respondents to consider the application submitted by the petitioners on 22.04.2019 and pass appropriate orders in accordance with law. Government Pleader appearing for the respondents had contended that the case of the petitioners would be considered and appropriate orders would be passed on the application submitted by the petitioners.
In view of the above submissions made by learned counsel for respective parties, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the application submitted by the petitioners on 22.04.2019 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the above directions, the writ petition is disposed of. No order as to costs.
