THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3160 of 2022 ORDER:

This Criminal Petition filed under Section 437 & 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Sole Accused on bail in connection with Crime No.25 of 2022 on the file of Moghalpura Police Station, Mirchowk, Hydereabad. 2.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The allegation against the petitioner is that he threatened the victim girl over a period of time and also outraged the modesty by kissing her and touching her chest; and that the victim girl is the sister of the petitioner herein. 4.

Learned counsel for the petitioner submits that the petitioner is studying B.Com.; that his exams are scheduled from 16.04.2022; and that there is likelihood of loosing academic year if he continues to be in jail.

Having regard to the fact that the petitioner is having examinations from 16th of April, 2022, this Criminal Petition is allowed and the petitioner is directed to be released on bail on the following conditions.

i. the petitioner/Sole Accused is directed to be released on bail on his executing personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for likesum, to the satisfaction of XII Additional Metropolitan Sessions Judge, Hyderabad.

ii. On such release, the petitioner/sole accused shall appear after 25.04.2022 before the concerned Police Station on every Sunday and Thursday for a period of three months or until filing of charge sheet, whichever is earlier. iii. The petitioner/sole accused shall not in any manner contact the victim girl or her relatives.

iv. The petitioner/sole accused shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
