This appeal is preferred by the applicant against order dated 06.04.2010 passed in OAA No.276 of 2006 by the Railway Claims Tribunal, Secunderabad Bench.

Appellants, who are wife and sons of the deceased Challa Venkata Krishnaiah submitted application to the Railway Claims Tribunal claiming compensation that the deceased picked up medicines in the District Veterinary Hospital at Nellore on 14.07.2005 and was traveling from Nellore to Gudur in a train carrying passengers, and when he fell down and died at Venkata Chalam Station at KM No.157/19-21 and that he lost his ticket in the accident.

Railways resisted the claim application of the claimants. 4.
Basing on the contentions, the tribunal after examining AWs.1 and 2 and marking Exs.A1 to A.5 on behalf of the claimants and after hearing railways dismissed the application. 5.
Learned standing counsel for the Railways submitted that the order passed by the tribunal is well considered and needs no interference of this Court.

A perusal of the material available on record and having regard to the facts and circumstances of the case, the tribunal has rightly dismissed the application of the applicant on proper appreciation of evidence and material available and hence, the appeal fails and the appeal is liable to be dismissed.

Accordingly, the appeal is dismissed confirming the order dated 06.04.2010 passed in OAA No.276 of 2006 by the Railway Claims Tribunal, Secunderabad Bench. There shall be no order as to costs.
